Terms of Service

These terms keep things clear between us: what Auxflo provides, what we ask of the businesses that use it, and how billing, data, and responsibilities work. Plain-English summaries appear throughout, but the full text governs.

1. Agreement to these terms

These Terms of Service (“Terms”) are a binding agreement between you and Auxflo (“Auxflo,” “we,” “us”). By creating an account or using the service, you agree to these Terms and to our Privacy Policy. If you are using Auxflo on behalf of a business, you represent that you have authority to bind that business, and “you” refers to the business.

2. The service

Auxflo provides an AI-powered phone receptionist and front-office platform: answering inbound calls, responding to and sending text messages, transcribing conversations, capturing leads, and booking appointments on your behalf. Features vary by subscription plan as described on our pricing page.

Auxflo is an automated system. While we work hard to make it accurate and reliable, you are responsible for reviewing captured information (appointments, quotes, customer details) before relying on it, and for how your business responds to the communications Auxflo handles.

3. Accounts

  • You must provide accurate information when creating an account and keep it up to date
  • You are responsible for safeguarding your login credentials and for all activity under your account
  • You must be at least 18 years old to use Auxflo
  • Notify us immediately if you suspect unauthorized access to your account

4. Subscriptions, billing, and cancellation

  • Auxflo is billed as a monthly subscription at the rate for your selected plan, charged in advance
  • Free trials convert to paid subscriptions only if you choose a plan; we don't charge you during the trial and no credit card is required to start
  • Plans include the call volumes described on the pricing page; overage rates, where applicable, are also described there
  • You can upgrade, downgrade, or cancel anytime from your dashboard. Cancellation takes effect at the end of the current billing period, and we do not provide prorated refunds for partial months
  • We may change pricing with at least 30 days' notice; changes apply at your next billing cycle

5. Your responsibilities and acceptable use

You agree to use Auxflo only for lawful business purposes. In particular, you agree that you will not use the service to:

  • Send spam, unsolicited marketing, or messages that violate telemarketing and messaging laws (including the TCPA and carrier messaging policies)
  • Record calls without any legally required consent or disclosure in your jurisdiction — call recording laws vary by state, and compliance is your responsibility
  • Impersonate another business, mislead callers about who they are speaking with, or use the service deceptively
  • Attempt to probe, disrupt, or reverse-engineer the service, or resell it without our written consent

We may suspend or terminate accounts that violate these rules or that create risk for callers, carriers, or the platform.

6. Your data

You own your business data — your leads, call recordings, transcripts, messages, and customer records. You grant us the rights needed to process this data to operate, secure, and improve the service, as described in our Privacy Policy. You are responsible for having the necessary rights and consents to share with us any personal information about your customers and callers.

7. Third-party services

Auxflo is built on third-party infrastructure, including telephony carriers, AI voice providers, and payment processors. Their availability affects ours, and their terms may apply to portions of the service (for example, carrier messaging rules). We are not responsible for outages or changes in third-party services, but we will always work to restore service promptly.

8. Disclaimers

The service is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that every call will be answered, transcribed accurately, or booked correctly. Auxflo is not an emergency service and should not be relied on to route emergency (911) communications.

9. Limitation of liability

To the fullest extent permitted by law, Auxflo will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or business opportunities — including losses arising from missed calls, incorrect bookings, or transcription errors. Our total liability for any claim arising out of the service is limited to the amount you paid us in the twelve (12) months before the event giving rise to the claim.

10. Indemnification

You agree to indemnify and hold Auxflo harmless from claims arising out of your use of the service in violation of these Terms or applicable law — including claims from callers relating to call recording consent or messaging compliance where you failed to meet your legal obligations.

11. Termination

You may stop using Auxflo and cancel at any time. We may suspend or terminate the service for breach of these Terms, non-payment, or risk to the platform, with notice where practical. Upon termination, you may request an export of your data within 30 days, after which we may delete it in accordance with our Privacy Policy.

12. Changes to these terms

We may update these Terms as the service evolves. For material changes we will give account holders advance notice by email or in-app message. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.

13. Governing law

These Terms are governed by the laws of the State of Indiana, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Indiana, and both parties consent to their jurisdiction.
